The regulation clearly defines that children's cosmetics are applicable to children under 12 years old (including 12 years old). Among them, there are strict requirements for the packaging of children's cosmetics: words such as "food grade" and "edible" or relevant patterns are not allowed to be marked, and "attention" or "warning" should be used as a guide, and warning words such as "should be used under adult supervision" should be marked on the visible surface of the sales package.

Previously, many children's cosmetics and toothpastes were marked with words such as "food grade" on the packaging to attract consumers to buy. On April 14, 2022, Beijing Miyun District Market Supervision Bureau imposed an administrative penalty of 1500 yuan on the illegal advertisement of Amos Technology Co., Ltd. when selling children's toothpaste. On January 4, 2022, Miyun District Market Supervision Bureau received a report that the party concerned used the propaganda phrase "safe to eat and swallow" when selling "amous baby toothpaste and children's toothpaste" in its online store "anmous flagship store". After verification, the report is true.

This time, the cosmetics supervision and Administration Department of the State Food and Drug Administration stated that the specific rules for the management of children's toothpaste with reference to the provisions on the supervision and administration of children's cosmetics will be clarified in the "toothpaste supervision and administration measures" and its supporting regulations, and its supervision work will be implemented in accordance with the "toothpaste supervision and administration measures" and supporting regulations issued later. The cosmetics supervision and Administration Department of the State Food and Drug Administration said that according to the regulations on the supervision and administration of cosmetics, toothpaste is not included in the definition of cosmetics, but is managed by referring to ordinary cosmetics. The specific reference method is determined by the "toothpaste supervision and administration method" promulgated later.
